Now Ellison, who maintains the previous owner said the trees would be regularly trimmed and maintained (which the owner denies), is suing to have the trees removed, reports Business Insider:

Larry Ellison has hired an attorney who specializes in neighbor's-trees-blocking-your-view litigation and sued the Von Bothmers to force them to cut down the trees. In connection with this litigation, he has already submitted a 207-page deposition, in which he revealed that, when a neighbor complained about redwoods on his property in the Valley blocking her view, he chopped them down.

Hilariously, the Von Bothmers have found several limbs from the controversial trees in their yard, allegedly trimmed by rogue lumberjacks that Ellison has since denied hiring. An attempt to "top" one of the trees was foiled by Mrs. Von Bothmer when she confronted three of the lumberjacks who were up in the tree at the time.

It?s Memorial Day weekend, the unofficial start of summer, and what better way to celebrate with friends and family than with some good ol? southern barbecue? ?Well, Time Home Entertainment recently released its app version of?Southern Living Big Book of BBQ and as part of our Get Cooking with iPad series, I?m going to give you my take on it.

I?ve been a Southern Living Magazine subscriber for years and one of the things I appreciate in every monthly issue is the beautiful spread of decorating and recipe photos. ?The Big Book of BBQ app does not disappoint, delivering a nice collection of barbecue and recipe related photos. ?Viewable in both portrait and landscape mode, a swipe of a finger will take you from preparing the grill to cooking dessert and everything in between.

Recipes include a list of ingredients, a breakdown of time requirements (prep time, chill time, grill time, etc.) and directions. ?Some recipes also include additional bits of information in audio and video clips, cooking tips, advice on tools to use and extra recipes. ?Cooks have easy access to the Table of Contents, can jump from recipe to recipe or access the Southern Living website simply by tapping the bottom of the iPad screen and selecting the desired option.

I found this BBQ app to be a nice colorful cookbook with tasty looking, easy to prepare recipes,?much like those included in Southern Living?s numerous traditional cookbooks. ?However, while the app includes many of the basic interactive features found in other cooking apps, it has received some criticism from customers for its lack of detailed ?how-to? videos and features, like the ability to create shopping lists and mark favorite recipes. ?I didn?t miss those features but if you are looking for richer interactive features in your cookbook app, then this might not be for you. ?Personally, I think the content looks great and makes up for some of the missing bells and whistles you might find in other cooking apps.

If you?re looking to fire up your grill and enjoy the three day weekend, you can pick up the Southern Living Big Book of BBQ app in the App Store today for $7.99.

What I liked: I found this app easy to maneuver and enjoyed perusing the photos and tasty looking recipes.

What I didn?t like: The?videos were short and duplicated in a number of the recipes. ?There were also no video demonstrations detailing recipe preparation and cooking, which I find to be a nice bonus. ?Although it is not something that bothers me, some users may not like the fact that there is?no way to create a grocery list or mark favorite recipes.

To buy or not to buy: At $7.99, this Big Book of BBQ is more expensive than many competing apps and still lacking in a few areas, but if you are a Southern Living fan, you might decide to bite the bullet and make the purchase strictly for the recipes. ?If you?re on the fence and still not sure, wait for this one to go on sale and pick it up then.

The Man Who Swims With Coelacanths

More than seven decades later, the words have the same urgency as when they rolled off Marjorie Courtinay-Latimer?s telegraph machine and into history:

?MOST IMPORTANT PRESERVE SKELETON AND GILLS = FISH DESCRIBED.?

Courtinay-Latimer was the young curator of a natural history museum on South Africa?s east coast. The message came from J.L.B. Smith, an icthyologist to whom she?d turned when, shortly before Christmas in 1938, local fishermen brought her a fish unlike any they?d ever seen.

Caught at a depth of 240 feet, it was five feet long, covered in bony scales and had fins reminiscent of legs. Courtinay-Latimer immediately sent a sketch to Smith, who thought it looked like a coelacanth. There was just one catch: Coelacanths were extinct, and had been for 70 million years.

Smith?s famous cable came too late, as Courtinay-Latimer didn?t have an aquarium large enough to preserve the fish. But even as they despaired, it was just weeks before another arrived. Far from being extinct, coelacanths were actually caught with some regularity by native fishermen of the Comoros Islands, on whose rocky undersea slopes they?d lived since swimming with dinosaurs.

The coelacanths of the Comoros Islands, along with another population discovered in Indonesia, are now celebrities of the animal kingdom, and nobody has spent more time with them than Hans Fricke. In 1986, the German explorer and then-freelance photographer convinced a magazine editor to send him and a submarine to the Comoros. Since then he?s led more than 400 dives, helping to produce much of what is now known about coelacanths.

After the publication of his latest work, published in Marine Biology and entitled ?The population biology of the living coelacanth studied over 21 years,? Wired.com talked to Fricke about his time with the mysterious, magnificent creatures.

Wired.com: How did your interest in coelacanths begin?

Hans Fricke: When I was young, I read the book by J.L.B. Smith, Old Four Legs. I was a keen skin diver, because I was 11, and I said, ?Good friend, this fish you will see once in your life.? In 1975 I joined an expedition of the Royal Society to Aldabra Atoll, and then I went to the Comoros, where I did some very stupid, very daring scuba dives to down over 300 feet. But I found nothing. I said to my wife, ?Next time I come here, I?m coming with a submarine.? I said it as a bit of a joke, but the next time I came to the Comoros, in 1986, I came with a submarine.

Wired.com: Can you describe that first submersible?

Hans Fricke. Dinofish.com

Fricke: It was made by two Czechoslovakian engineers in Switzerland. We made the first trials in Lake Constance, then I smuggled the submersible over the Swiss-German border, because I would have had to pay customs. It was covered in a sheet and looked like an American Sherman tank. The border policeman asked me, ?Friend, what is below this sheet?? I said, ?A submarine.? He said, ?No.? I said, ?Yes it is. I was in the lake diving,? and told him some fish stories. He found it really interesting, and forgot to ask the crucial question: if I?d paid customs.

Wired.com: When did you first find a coelacanth?

Fricke: We tried hard to find the fish, but we didn?t look carefully enough, we didn?t know about its behavior. The fish are nocturnal, and hide during the day.

I had to fly back home to Munich, and two of my friends continued for five more days. They found it. Of course my friends immediately called my family. I had a stopover in Paris, called my family, and my little son said, ?How is the fish?? And I said, ?Which fish?? He said, ?The coelacanth!? This was a great moment. I had tears in my eyes. I went back a couple weeks later, and on the first dive we found them.

Wired.com: What is it like to see one?

Fricke: You immediately grasp that something is fishy with this fish. It is not a normal fish. Their movements are extremely slow; it has something like a mute character. I had the feeling I had an amphibian in front of me, because of the movements of the fins.

I discovered a very funny, tetrapod-like movement of the fins, a kind of cross-step that they do. If you were to cut a coelacanth across the middle, you?d see that it?s almost an ellipse. If one make a downbeat with its right pectoral, the beast turns. To counter this, it has to make a counter-downbeat on the far left side. This produces the tetrapodic cross-step. It?s a normal thing for an animal on land, but we?re talking about a fish. This could be a pre-adaptation for the step to land.

They move so slowly. J.L.B. Smith said this gives you impression they crawl on their fins at the bottom of the sea, but they don?t. They don?t even touch with their fins.

Wired.com: If they move so slowly, how do they capture prey?

Fricke: They have a giant electroreceptor in their head, called the rostral organ. They perceive the electric field which a swimming object in salt water produces.

Lava fields have reduced magnetic anomalies, and if you swim as a fish in this field, of course you produce in your own body an electric field which you could measure. It is very likely the fish orientates himself via detecting magnetic anomalies in seawater. It?s amazing ? it?s a landscape like Hell, like the lava fields in Hawaii, and they go into this field and orient themselves precisely and fast.

Wired.com: How do juveniles find homes?

Fricke: We never found a juvenile. We are very puzzled by the fact that we see only sub-adults. That means they must live somewhere else, and we don?t know where. We had once a pregnant female radio-marked with a pinger, and she did something extraordinary: She went down to 2,300 feet and remained for the day at that depth. Something must have happened with her. I believe she gave birth, but I could not follow her and see if her abdomen was still swollen and prove it. But it makes sense that they live down there. If a juvenile swam in front of an adult, they?d eat it.

?They need about 12 grams of food a day. This is probably the secret of their evolutionary success.?

Wired.com: It takes three years for an embryo to develop. Why so long?

Fricke: They have the slowest metabolic rate known among vertebrates. We made a calculation that a coelacanth needs, for its resting metabolism, 3.8 milliliters of oxygen per kilogram per hour. A tuna needs 400 milliliters. Because coelacanths are always burning at a low metabolic flame, they are able to live in low-energy areas, where there isn?t much food. The lava fields are a low-product habitat. They need about 12 grams of food a day. This is probably the secret of their evolutionary success. They live where hyperactive fish cannot survive.

Wired.com: Is climate change going to be a problem?

Fricke:With each water temperature increase of 10 degrees Fahrenheit, metabolic requirements are doubled, so they have to live under a special temperature regimen. They live in areas with a temperature of 59 to 64 degrees Fahrenheit. It?s there that their hemoglobin has the best capacity for oxygen. They can?t live anywhere else. They also need caves. If there are no caves, the fish can?t survive.

We did a study with [Microsoft co-founder] Paul Allen?s fantastic equipment, which let us dive very deep. And the sad story in the Comoros is, the volcano is eroded below 650 feet. There?s no place to hide there. In 1991, when there was an El Nino happening, we found 40 percent fewer coelacanths in our area. At 720 feet, it was 77 degrees Fahrenheit. The fish would be in respirational stress.

With climate change, if the water temperature increases, they would have to go deeper, but there are no caves. And this would be the end of the Comoros population.

Frequent rain (and snow) and predominantly cloudy skies are to blame.

A sudden jump into or too much time in cold water can lead to cramping, shock, heart attacks and drowning.

Even while ocean water temperatures along the Atlantic coast are running well above average for this point of the year, they are still chilly when compared to July and August.

The first three that I have listed are for those who love beautiful scenery, and enjoy outdoor activities. Big Bear Lake offers beautiful mountain scenery, while Santa Catalina Island and Pismo Beach treat visitors to some of Southern California?s finest beaches. Now, here is some information on each of these areas to wet your vacation appetite.

Big Bear Lake

Big Bear Lake, California is a four seasons resort community surrounded by the San Bernardino National Forest. It is approximately 80 miles northeast of Los Angeles, California. The area offers a wide range of cabin rentals, and vacation rentals for year-round family fun. Activities include boating and water sports, fishing, hiking, horseback riding, golfing, skiing, snowboarding and many other fun family activities.

The San Diego Zoo is one of the best in the world. Be sure and visit Sea World while you are there for some fun and excitement. Also, visit a nearby beach, go shopping in Old Town San Diego, or take a stroll through Balboa Park.

Whether you visit Big Bear Lake, Disneyland, San Diego, or one of these other destinations, it will truly be a memorable trip. The main thing is to make time for these special outings with your family, have fun and relax, and create lasting memories. Start planning that special family trip ? you deserve it. CNBC Anchorman Mark Haines Dies

CNBC anchorman Mark Haines died unexpectedly Tuesday evening. He was 65 years old. Haines hosted morning business news programs on the cable channel for 22 years.

Mark Haines, one of CNBC's most visible and popular anchors, died suddenly last night at age 65. He helped turn the network into one of the country's leading business news outlets.

As NPR's Jim Zarroli reports, Haines was the seasoned observer of the business world, known for sometimes clashing with his guests.

JIM ZARROLI: Mark Haines was already a broadcast veteran when he came to CNBC. He stayed for 22 years, most recently as co-anchor of "Squawk on the Street," which was broadcast from the New York Stock Exchange. Haines had a genuine presence on the air and he was comfortable in his own skin, says CNBC anchor David Faber, who worked with him for years.

Mr. DAVID FABER (Anchor, CNBC): What you saw is what you got, and I think that's why people responded to him so much.

ZARROLI: Haines had been unflappable authority and credibility that served viewers well in difficult times, like September 11th.

Mr. MARK HAINES (Anchor, "Squawk on the Street," CNBC): It's not accidental that the first tower just happened to collapse and then the second tower just happened to collapse in exactly the same way. How they accomplished this, we don't know.

ZARROLI: Haines sometimes projected a kind of genial befuddle air, and he wasn't afraid to ask questions that might sound dumb. But behind the persona, he was an astute observer of Wall Street. He was an early skeptic about the dotcom boom. And in early 2009, after stocks had plunged, he was among the first journalists to say they had reached a bottom.

Haines was a graduate of the University of Pennsylvania Law School, and Faber says he could be a relentless questioner of guests.

Mr. FABER: It really was more about the answers themselves or the lack thereof that seemed to drive him nuts and that then really sent him to that level where he became ferocious, and an incredibly strong questioner.

ZARROLI: A few years ago, Haines clashed on air with Barney Frank, then the chairman of the House Financial Services Committee, and Frank grew so angry he cut the interview short.

Representative BARNEY FRANK (Democrat, Massachusetts): What you have collectively suggested, let's do nothing at all. Let's acknowledge that there...

Mr. HAINES: No, I have not suggested that.

Rep. FRANK: I'm sorry. Please stop interrupting me.

Mr. HAINES: I am not going to let you...

Rep. FRANK: All right, excuse me. If you want lose me...

Mr. HAINES: I am not going to let you...

Rep. FRANK: If you want lose me...

ZARROLI: But Haines was no ideologue. He took on conservatives over tax policy. He squared off against economist Martin Feldstein when he criticized President Obama's plan to overhaul health care.

Those exchanges could make some people on Wall Street angry. But when Haines' death was announced this morning, traders at the stock exchange observed a spontaneous moment of silence.

Welcome to this week's exercise in irresistible-fat-joke TV, courtesy of Lifetime and "Jersey Shore" producer Sally Ann Salsano. Once you get past the risible title, though -- "Love Handles: Couples in Crisis" -- there's nothing particularly new on this docuseries' menu, which blends the relationship show and diet/workout makeover together into one high-schmaltz-content entree, where talk about BMI (or Body Mass Index) flows as freely as tears. Despite its corny elements, in a country fighting and often losing the battle of the bulge, "Handles" seems destined to latch onto an audience, filling a flabby niche "Oprah" successfully explored. Granted, this is one of those no-cliche-unturned reality concepts, constructed around the "It takes a village to fix a couple" theory. Focusing on two tandems in each hour, the participants (including two same-sex couples out of 16 featured) are put through a regimen that involves sessions with personal trainers and therapists as well as meeting with a doctor. By offering self-contained episodes, the show doesn't have a lot of time to waste. In fact, following each duo's multi-week journey from introduction to conclusion -- the whole arc of a relationship, and its potential salvation, in less than 22 minutes -- requires a lot of shorthand. It's an approach that feels rather ironic -- peddling instant gratification, storytelling-wise, within a series that promotes the merits of patience, hard work and commitment. In a way, the producers have taken relatable problems that could assail any couple, and magnified them (sorry) through the filter of obesity. "I would love to have romance back in our marriage," one woman, Tyese, laments in the premiere, citing how long it's been since she and her husband were intimate. (Thin couples can be unhappy, too, but don't get to visually demonstrate their ordeal via painful sessions with personal trainers.) To more cynical eyes, the counseling sessions can be unintentionally funny in their melodrama, as one woman shrieks, "I deserve to be loved!" in a kind of primal scream. Still, the bottom line is that "Handles" shrewdly taps into areas of widespread concern generally associated with daytime TV -- weight loss and relationships -- and repackages them into an hour. "Failure could destroy their relationship," the narrator intones dramatically at the outset. True, but the struggle could sustain the show, demonstrating that America's appetite for cheesy junk doesn't end at the fast-food counter.

Investing in Precious Metals: Is Gold Worth Dying For? ? GoldCaddy.com

On Thursday, gold (NYSE:GLD) and silver (NYSE:SLV) took a breather as the Dow (NYSE:DIA) and SP 500 (NYSE:SPY) closed slightly higher. ?The markets seem somewhat confused as the Greek debt crisis lingers on. ?In times of uncertainty, investors often turn to gold as a place of refuge. ?However, just how expensive is it to really obtain gold? ?Some gold miners (GLDX) may find out the hard way.

The medical condition known as silicosis could be a potential problem for some gold miners. ?Silicosis is the scarring of the lungs caused by extended exposure to the dust found in South African mines. ?These mines are now run by companies such as Harmony Gold Mining (NYSE:HMY), Gold Fields Ltd.(NYSE:GFI), and AngloGold Ashanti Ltd. (NYSE:AU). ?These miners are now facing coming lawsuits. ?HMY fell the hardest on the day, closing 3.57% lower.

While the total number of claims and size of judgements are nearly impossible to estimate at this time, RBC Capital Markets claims the liability of mining companies could reach as high as $100 billion. ?RBC reached this estimate by assuming there are 300k claimants, each suing for at least 2 million rand. ?The Constitutional Court said workers who qualified for state benefits for occupational related disease, could also receive additional compensation from their former mining employers.

Gold Fields Ltd (NYSE:GFI)?CEO Nicholas Holland said, ?It?s speculative at this stage to assume that there?s going to be a huge number of suits or whether in fact those suits will even be successful.? ?Another miner, Anglo American, is already involved in a silicosis suit that dates back to 2004, and involves 18 miners (4 of the 18 have already died). The mines today employ about 160k people, according to the Chamber of Mines.

Investors willing to overlook the lawsuits may want to consider the following ETFs and stocks:?iShares Silver Trust (NYSE:SLV),?PowerShares DB Silver Fund (NYSE:DBS),?ProShares Ultra Silver (NYSE:AGQ),?First Majestic Silver Corp. (NYSE:AG),?SPDR Gold Trust (NYSE:GLD),?Market Vectors Etf Trust (NYSE:GDX), or?Barrick Gold Corporation (NYSE:ABX).

Investors who are bearish in precious metals, or simply looking for a hedge, may find the following stocks, ETFs, and ETNs interesting:?ProShares UltraShort Silver (NYSE:ZSL),?PowerShares DB Gold Short ETN (NYSE:DGZ), or?PowerShares DB Gold Double Short ETN (NYSE:DZZ).

Would you rather have three seconds of an insurance prospect?s attention, or 15 minutes of his devoted attention? Of course, all of us would opt for the 15 minutes. That time is the difference between scanning an ad and reading an article in a business journal.

What you need to know

If you want to write an insurance article for submission, take the time to write a genuine, smart article that proves your expertise, that is educational, and that is of interest to your audience. Forget that you are trying to sell something. Any submission that reads even faintly as promotional will be rejected. All editors want articles that are newsworthy. Try to tackle an insurance industry pain point and then take it one step farther and offer relevant solutions.

And remember, never pay to have an insurance article published and avoid advertising for the purpose of seeing your article in print. Reputable magazines never charge you to publish articles; they want insurance stories that are newsworthy.

Doing Virtuous Business: The Remarkable Success of Spiritual Enterprise by Theodor Roosevelt Malloch is a business ethics book written in a Christian perspective.

Malloch first describes the history of religion as it pertains to economics and business, and from there, delves into the sociological aspects of business and economics.

The virtues as described by Malloch include "hard" virtues such as leadership, and "soft" virtues such as forgiveness. In this book Malloch describes the virtues that are indespensible in running any type of business- profit or non-profit in a way that honors God.

I think this should be required reading for anybody obtaining a business license or whatever it is that the government issues to those who are incorporating. I think there are many ideas here for the entrepeneur or executive who wishes to run a successful enterprise while respecting his fellow man and his spiritual beliefs.

Late Night 'Thank You Notes' From Jimmy Fallon

Every single day of Jimmy Fallon's life is like Thanksgiving. The comedian and host of Late Night tells Fresh Air's Terry Gross that he is appreciative of the word moist ? for being the "worst word ever." He's thankful, too, for taco shells that have survived their long journey from factory to supermarket to his plate ? and then break the moment he fills them. And he's grateful that the name Lloyd starts with two L's. Otherwise, he says, it would just sound like "Loyd."

Fallon collects more than 100 nuggets of gratitude in his book, Thank You Notes. The book is based on a reoccurring segment on Late Night, when Fallon and his staff round up mundane things that don't get enough attention and give them each the praise they deserve.

"Like do you ever go down the hallway at work and there's someone walking at the same speed as you and right next to you so you're almost like walking together?" Fallon asks. "And you don't know who they are so you're like, 'Should we hold hands? Are you going to slow down? Do I speed up? One of us has to make a decision here.' So those types of things, they're just random but you go, 'Oh, yeah, there should be a joke somewhere about this.'"

Fallon has spent most of his career coming up with jokes and doing impressions. His early impersonations of Jerry Seinfeld, Bill Cosby, Pee-Wee Herman, Adam Sandler and Eddie Murphy helped get him an audition in front of Lorne Michaels and then a job on Saturday Night Live, where he stayed for six years. After leaving the show to appear in several films, he was tapped by NBC to become the host of Late Night, after Conan O'Brien left in 2009 to prepare to take over Jay Leno's slot on The Tonight Show.

When he's not interviewing guests, Fallon spends a lot of time on Late Night impersonating musicians. He does spot-on versions of Bruce Springsteen, Bob Dylan, John Mayer and Neil Young. Last November, his Neil Young even famously dueted with the real Bruce Springsteen on a cover of Willow Smith's "Whip My Hair." The resulting duet became one of the most popular segments in Late Night history.

Fallon says that he's had always had a good ear for imitating others. At two, he perfected a James Cagney routine. By high school, he had Jerry Seinfeld down pat.

"I just had that thing, when I was growing up, where I'd just start talking like people," he says. "I would go visit a friend of mine's house and my mom would say 'You sound like Joey Gonzalez' because I would sound like my best friend."

Occasionally, he even runs into a celebrity right after he does his impersonation on Late Night. A recent segment parodied Donald Trump, whose show Celebrity Apprentice was interrupted by the news that Osama bin Laden had been killed.

Just after the taping, Fallon ran into Trump himself. "And I said, 'Hey Mr. Trump, I did an impression of you on the show that's airing tonight.'"

"You do great impressions," Trump replied.

"I don't want you to be upset," said Fallon.

Trump turned to rest of the people seated at his table and announced, "Jimmy Fallon's doing an impression of me tonight!"

"He knows I never kick anyone when they're down," Fallon says. "I kick them when they're up and they don't mind."


Interview Highlights

On his 'Whip My Hair' performance

"I think every impressionist has a Neil Young but you don't know what to do with it. It's like having a Jack Nicholson. Everyone has one. What do you do with it? So one of my writers said, 'Why don't you do a Neil Young doing a nice version of Willow Smith's 'Whip My Hair?' ... So we have a guitar and we're sitting in my office, trying to think of how Neil would do it."

On how he practiced for his gig at Late Night

"I would sit to the left of my wife every night at dinner and look at her and try to ask her about her food and stuff but you don't know what it's like until you're in the situation and talking to people. I interviewed strangers. I interviewed my mom. ... She was an awful guest. She kept wanting to cut to a clip. And we have no clip. She's not in a movie. She's my mother."

On reenacting Saturday Night Live as a child

"I was obsessed with the show and this is back when VCRs had just started to come out. ... I remember being obsessed with [the show]. My parents would tape it and they would watch it and cut out any sketches that were risque or dirty or things that we couldn't see. And the ones that were clean, we would be able to watch, me and my sister Gloria."

On Weekend Update

"Colin Quinn was leaving Weekend Update and Lorne Michaels said, 'Jimmy, I think you'd be great at doing Weekend Update.' And I said, 'I don't think so. I don't really read the newspaper all that much. I don't know much about the news. I'm the worst person for Weekend Update. Thank you so much. But no thank you. I'd rather not do it.' He said, 'I think it should be someone from the cast.' So they had auditions. A couple writers were auditioning. One of the writers auditioning was Tina Fey. She was just a writer at the time who wrote a lot of stuff for me and she was super fun and super funny and super hard-working. And sharp ? almost too sharp just to be by herself at the time.

"So I saw her audition, and I said, 'Tina's audition was amazing. It was hilarious.' And I talked to Lorne and he said 'I really think you should still do it. Tina's the head writer. No one knows who she is.' And I go, 'What about me and Tina?' And he goes, 'Yeah. I like that. I would see what that's like.' So he set up a test screening of Tina Fey and I in Conan O'Brien's studio over a weekend and we did a test run of what our Weekend Update would be like. And Lorne said, 'I think it would be great because she's the smart one and you're the guy who forgot to do his homework and you need to cheat off her. That's the dynamic.' And we got together and man, it just clicked."
